Supreme Court Justice Officiates at Same-Sex Marriage

I thought this was pretty cool.

Justice Ruth Bader Ginsburg will become the first Supreme Court member to conduct a same-sex marriage ceremony Saturday when she officiates at the Washington wedding of Kennedy Center President Michael M. Kaiser.

“I think it will be one more statement that people who love each other and want to live together should be able to enjoy the blessings and the strife in the marriage relationship,” Ginsburg said.

Could you imagine an Antonin Scalia, Samuel Alito or Clarence Thomas ever making that kind of statement? Not in this lifetime. In fact, here is what Scalia recently said on the court’s two latest rulings in favor of same-sex marriage.

“…it’s not up to the courts to invent new minorities that get special protections.”

Only a homophobic, close-minded, mean-spirited asshole (aka Antonin Scalia in all his glory) would refer to the LGBT community as a “new” minority. I think we can safely say that gays and lesbians have been with us since those first days when our ancestors climbed down from trees – another issue, btw, which Scalia takes issue with. Here’s a snippet of his dissent from Edwards vs. Aguillard, a ruling which prevented Louisiana schools from teaching phony “creation science” in the classroom.

The body of scientific evidence supporting creation science is as strong as that supporting evolution. In fact, it may be stronger…. The evidence for evolution is far less compelling than we have been led to believe. Evolution is not a scientific “fact,” since it cannot actually be observed in a laboratory. Rather, evolution is merely a scientific theory or “guess.”… It is a very bad guess at that. The scientific problems with evolution are so serious that it could accurately be termed a “myth.”

Anyone with the slightest knowledge of science should be able to recognize Scalia’s dissent as little more than a pile of lies and ignorance. It is stupid. Evolution could be termed a myth? Really? A Supreme Court justice actually wrote those words? Amazing…and pathetic. Hey, Scalia is 77 so we can expect Hillary to replace him with a competent judge at some point in her first term. If not then, her second term for sure.

 Indeed, teach them well.

Almost a month after the Supreme Court’s landmark decisions in favor of marriage equality were handed down, one son of dissenting Justice Antonin Scalia will speak in front of Courage, an organization that believes gays and lesbians should never have sex.

Overshadowed by his father for years, the similarly anti-gay opinions of Scalia’s son Paul, however, are beginning to attract attention as well. An important tenet of the younger Scalia’s position on homosexuality is his belief that being gay is not an immutable characteristic or identity.

In 2005, Scalia espoused this view in an article for the magazine First Things, where he warned about high school clubs that encourage tolerance of homosexuality, and readily label themselves or others “gay” or “homosexual.”

“[Labels] presume that a person is his inclinations or attractions; he is a ‘gay’ or is a ‘homosexual,'” Paul Scalia wrote. “At some point adults have to admit that a fifteen-year-old who claims to be ‘a questioning transgendered bisexual’ is really just confused.”

 Scalia’s general thought process is perhaps best summed up, however, in a 2012 article written for Humanum: Issues in Family, Culture & Science.

“In short, we should not predicate ‘homosexual’ of any person. That does a disservice to the dignity of the human person by collapsing personhood into sexual inclinations,” Scalia writes. “Indeed, the Church is still trying to find the right vocabulary to speak about this modern phenomenon … Either our sexuality is oriented in a certain direction (i.e. toward the one-flesh union of marriage), or it is not. We cannot speak of more than one sexual ‘orientation’ any more than we can think of the sun rising in more than one place (i.e. the orient).”

As one person noted, the bigot did not fall far from the tree.

Antonin Scalia – A Limbaugh With Robes

Whatever the outcome of the Supreme Court hearing on same-sex marriage, history tells us that whenever the forces battling for equality reach a tipping point (as they inevitably do), there is no stopping them. Marriage equality will be the law of the land this June…and if not, then some other June in the near future.

And when that history is written, one of the chief villains in this sordid tale of intolerance and ignorance will be Justice Antonin Scalia – for what sets this Supreme Court justice apart from every other bigot fighting to restrict rights, is the special joy Scalia takes in defending his homophobia.

Here are a couple of examples from a Mother Jone’s piece on the 7 worst things Scalia has ever said about homosexuality.

In 2003, during oral arguments in Lawrence v. Texas, the case challenging a Texas law that criminalized homosexual sex, Scalia came up with a tasteless analogy to illustrate the issue. “[S]uppose all the States had laws against flagpole sitting at one time, you know, there was a time when it was a popular thing and probably annoyed a lot of communities, and then almost all of them repealed those laws,” Scalia asked the attorney fighting the Texas law. “Does that make flagpole sitting a fundamental right?”

During oral arguments in Lawrence, the attorney challenging the Texas law argued that it was “fundamentally illogical” for straight people to be able to have non-procreative sex without being harassed by the state while same-sex couples did not have the right to be “free from a law that says you can’t have any sexual intimacy at all.” But Scalia pointed out that gays and lesbians could just have sex with people of the opposite sex instead. “It doesn’t say you can’t have—you can’t have any sexual intimacy. It says you cannot have sexual intimacy with a person of the same sex.” Later on in his dissent, Scalia argued that Americans’ constitutional right to equal protection under the law wasn’t violated by the Texas law for that reason. “Men and women, heterosexuals and homosexuals, are all subject to [Texas’] prohibition of deviate sexual intercourse with someone of the same sex.”

As the MJ piece points out, this was the exact same argument made by racists who defended bans on interracial marriages. The ban, the haters would say, was equally restrictive to both whites and blacks and, therefore, constitutional.

Whatever great legal mind Antonin Scalia once possessed, it is no longer the case. He is now a mean-spirited 77-year-old bigot who derives great pleasure in making outlandish statements and then sitting back and reveling in the reaction.

Scalia is, in the words of an observer, Rush with a robe.

Justice Scalia Places Homosexuality, Murder and Bestiality on the Same Footing

Antonin Scalia is one of the Supreme Court justices who will be ruling on marriage equality next year. This is what he had to say when asked why he finds no difference between laws banning sodomy and those barring bestiality and murder.

“I don’t think it’s necessary, but I think it’s effective,” Scalia said, adding that legislative bodies can ban what they believe to be immoral.”

“It’s a form of argument that I thought you would have known, which is called the ‘reduction to the absurd…if we cannot have moral feelings against homosexuality, can we have it against murder? Can we have it against other things?”

Any doubt as to which way Scalia will vote next summer? Scalia does ‘fair and balanced’ in the same way that Fox does news.

What this underscores is how important the Obama victory really was. Three judges will be in their 80s during the next four years and Mitt Romney had proudly proclaimed that he would appoint judges in the mold of Scalia.

The election win for President Obama prevents that from happening and another hate-filled homophobe right out of the Dark Ages will not be appointed to the highest court…at least for the next four years.
