Unlike Giuliani, Holder's stance in favor of civilian trials for cases like this (and against the constitutionality of the military tribunal system) has remained unchanged from the one he held while in private practice. I believe Giuliani's stance is political and Holder's is not.

Frances, do you believe Holder's decision to try these people in the Civil Justice System is politically motivated?

The only real fear the Repubs have is that if there has been enough torture to taint all the "confessions" of the terrorists, then 2 things might happen. One is that the case gets thrown out with out the confessions of the terrorists which I don't think will happen because there is enough other evidence. The other is that enough evidence of law breaking by the Bush Admin. will come out that other heads may roll because of the terrorists speaking of what happened upon their detention.

The New Yorkers I talk to online can't wait to get those terrorists on trial in New York! They talk like typical New Yorkers....bring it on! They want their chance to see the terrorists convicted and all the evidence brought to light about these guys. Then the victims want to have their day in court for the sentencing phase so they can put their suffering on the record and have their pain acknowledged by our system and the sentences meted out in accordance with the victims pain and suffering. And most of all, they want to throw it in the terrorists faces that our justice system still works and that we abided by law in meting out that justice they so richly deserve. That is why bringing them to New York is the best possible way to show the world that our system works and will not be defeated by these terrorists!

I'm of the opinion that the political cartoon is addressing the apparent fear from the Right that wasn't there when other terrorists were tried in civilian courts. I also believe that, in this case, the objections are politically motivated and that the concern for public safety or the feelings of the 9-11 families is insincere.

Frances, so you are of the opinion there are no other factors to be considered in trying terrorists and war criminals in the U.S. Judicial System other than Republican "fear and cowardice"?

You dismiss the concerns of 9/11 Victim's families? You dismiss the concerns of the citizens of New York that think this is a bad idea? You dismiss the concerns of the majority of Americans who are against this action? You dismiss the target painted on New York, New Yorkers and every participant in this procedure? You dismiss the exorbitant costs of conducting Holder's folly?

You think the ONLY objection or concern for this course of action is simply Republican fear and cowardice?

If you ask me, interpreting a criminal act as an act of war and parlaying it into two wars is an overreaction and an example of political expediency that went far beyond the current plans of the DOJ.

Overreaction by its very definition is never justified because it explicitly denotes a reaction that is beyond what is called for in a particular situation.

Mario's comment was not an oversimplification beyond the fact that he has accurately assessed the situation with a modest amount of words.

Frances asks, "...is there ever a good reason for people to over-react?"

You tell me Frances. Think of the mass hysteria among liberals every time Sarah Palin or Glenn Beck sneezes....then you tell me.

The oversimplification I was speaking to was Mario's comment.

TN, is there ever a good reason for people to over-react? Is there ever a good reason for public officials to display fear and paranoia?

Come to think of it, isn't a political cartoon THE place for oversimplification?

So. Are you saying it IS that simple. The "Right" is over reacting for no reason and therefore, the Terrorists "win"?
